Terms of Contract for Autophone of Laredo

1.Introduction

These Terms of Contract (“Terms”) govern the relationship between Autophone of Laredo (“we”, “us”, “our”) and the customer (“you”, “your”) regarding the provision of wireless internet services. By subscribing to or using our services, you agree to these Terms, which form a legally binding contract between you and Autophone of Laredo. These Terms comply with relevant Texas state laws and Federal Communications Commission (FCC) regulations.

2.Services Provided

  • Scope of Services

Autophone of Laredo provides wireless internet access and related services, subject to availability and plan limits. We adhere to FCC’s Open Internet Rules, which prohibit blocking, throttling, or unreasonable discrimination of lawful traffic on our network.

  • Service Availability

While we strive to provide uninterrupted service, availability may be impacted by factors such as geographic location, weather conditions, network congestion, maintenance, or equipment failure. No guarantee of uninterrupted service is provided. This limitation is permitted under FCC transparency requirements as long as we disclose our network management practices.

  1. Contract Duration Options

You may select from the following contract duration options based on the service plan you choose:

  • 24-Month Contract

You agree to a minimum commitment of 24 months for the service. Early termination fees will apply if the contract is canceled before the 24-month term is completed.

  • No Fixed Term (Month-to-Month)

If you select a month-to-month service plan, there is no minimum contract term. You may cancel the service at any time without incurring early termination fees.

The specific contract length will be confirmed at the time of subscription, and it may impact the pricing or benefits offered under your plan.

  1. Customer Obligations
  • Account Information

You agree to provide accurate and up-to-date contact, billing, and service-related information when subscribing to our services. You must notify us immediately of any changes to your personal or billing information.

  • Payment of Fees

You are responsible for paying all fees associated with the services, including recurring monthly fees, installation fees, equipment charges, and applicable taxes in accordance with Texas tax law. Late payments may result in service suspension or termination.

  • Customer Equipment

You are responsible for providing compatible equipment, unless otherwise stated in your service agreement. Autophone of Laredo is not liable for any issues related to third-party equipment unless it is leased from us.

  • Prohibited Uses

You agree not to use the service for illegal activities, including but not limited to:

  • Distribution of illegal content
  • Unauthorized access to other networks or systems
  • Cyberattacks (such as DDoS)
  • Any activity that violates FCC regulations or Texas state law, such as fraudulent use of telecommunications.

Violations may result in termination of your service and referral to law enforcement.

 

 

 

  1. Term and Termination
  • Service Term

Your service term is determined by the contract duration you select—12 months, 24 months, or month-to-month. The service will automatically renew unless canceled by either party.

  • Termination by Customer
  1. 12- and 24-Month Contracts: If you cancel the service before the end of the contracted term, you may be subject to an early termination fee. This fee will be outlined in your service agreement.
  2. Month-to-Month Contract: You may cancel the service at any time without early termination fees. Termination is effective at the end of the current billing cycle.

You must notify Autophone of Laredo in advance to cancel the service.

  • Termination by Autophone of Laredo

We reserve the right to terminate your service if you fail to comply with these Terms, including non-payment or breach of acceptable use policies. Notice will be provided where reasonably possible.

  1. Billing and Payments
  • Billing Cycle

Fees are billed monthly in advance, with overages or additional charges billed at the end of the month. Texas sales taxes and fees, as well as any other FCC-required regulatory fees, are applied.

  • Late Payments

If payment is not made on time, late fees may apply, and your service may be suspended. We reserve the right to charge a reconnection fee, as allowed under Texas law.

  • Billing Disputes

You must notify us of any billing disputes within 30 days. Failure to notify us within this timeframe constitutes acceptance of the charges, per Texas consumer law.

 

  1. Limitation of Liability
  • Service Limitations

Autophone of Laredo is not liable for indirect or consequential damages related to the use or inability to use our services. Texas law permits us to limit liability for issues beyond our control, such as natural disasters or third-party actions, in accordance with FCC rules on network transparency.

  • Force Majeure

We are not responsible for service interruptions caused by unforeseen circumstances such as natural disasters, equipment failure, or acts of government.

  1. Warranty Disclaimer

Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, as permitted under Texas law and FCC guidelines. Autophone of Laredo does not guarantee uninterrupted service.

  1. Indemnification

You agree to indemnify and hold harmless Autophone of Laredo, its officers, employees, and affiliates, against any claims arising from your use of the service, breach of these Terms, or violation of laws including Texas state law and FCC regulations.

  1. Compliance with FCC Regulations

Autophone of Laredo complies with FCC’s Open Internet Order, including transparency and non-discrimination rules. You acknowledge that network management practices, performance data, and service disclosures are available to you in compliance with FCC regulations.

  1. Changes to Terms

Autophone of Laredo reserves the right to modify these Terms at any time. Any material changes will be communicated to customers through email or on our website in accordance with Texas consumer laws and FCC transparency rules. Continued use of the service constitutes acceptance of the revised Terms.

  1. Governing Law and Dispute Resolution
  • Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

  • Dispute Resolution

Disputes related to these Terms or the service will be resolved through binding arbitration, in accordance with Texas law and FCC requirements. Arbitration will take place in Laredo, Texas, and both parties waive any right to participate in class-action lawsuits.
