Internet Service Agreement

 
This agreement supersedes any prior agreements or policies. The Autophone of Laredo General Terms and Conditions of Services will govern any matters not expressly covered in this agreement.
1. Introduction
Terms of Agreement ("Terms") govern the relationship between B & B Communications, LTD dba Autophone of Laredo ("we," "us," "our") and the customer ("you," "your") regarding the provision of wireless internet services. By signing this agreement and/or the act of starting to use the service, you agree to these Terms, forming a legally binding contract between you and Autophone of Laredo. These Terms comply with applicable Texas state laws and Federal Communications Commission (FCC) regulations.


2. Services Provided
Scope of Services: Autophone of Laredo provides wireless internet access and related services, subject to availability and plan limits. We adhere to the FCC’s Open Internet Rules, which prohibit blocking, throttling, or unreasonable discrimination of lawful traffic on our network.
Service Availability: While we strive to provide uninterrupted service, availability may be affected by geographic location, weather conditions, network congestion, maintenance, or equipment failure. No guarantee of continuous service is provided. This limitation complies with FCC transparency requirements, as our network management practices are fully disclosed.


3. Contract Duration Options
You may choose a contract term that best suits your needs. Available options may include fixed-term contracts or month-to-month arrangements. Fixed-term contracts require a minimum commitment period, and canceling before the end of this period will result in early termination fees. Month-to-month plans offer flexibility with no long-term commitment, allowing you to cancel without such fees. The specific terms of your contract, including any applicable fees and benefits, will be confirmed when you subscribe to a plan. The availability of contract options may vary depending on the selected service plan.


4. Customer Obligations
Account Information: When subscribing to our services, you agree to provide accurate and up-to-date contact, billing, and service-related information. Please promptly notify us of any changes to this information.
Payment of Fees: As per Texas law, you are responsible for paying all service-related fees, including recurring monthly fees, installation fees, equipment charges, and applicable taxes. Late payments may result in service suspension or termination.
Customer Equipment: You are responsible for providing compatible equipment unless otherwise specified in your service agreement. Autophone of Laredo is not liable for issues related to third-party equipment unless it is leased from us.
Prohibited Uses: You agree not to use the service for illegal or harmful activities, including but not limited to:
  1. Distribution of Illegal Content: Sharing, distributing, or accessing unlawful content, such as child exploitation materials, pirated media, or content that infringes on intellectual property rights.
  2. Unauthorized Access: Accessing or attempting to access networks, systems, or accounts without authorization, including hacking into other computers, networks, or databases.
  3. Cyberattacks: Engaging in Distributed Denial of Service (DDoS) attacks, phishing, malware distribution, or any other activities intended to disrupt or harm networks or systems.
  4. Violations of FCC Regulations, Federal or Texas State Laws: Engaging in activities prohibited by the Federal Communications Commission (FCC) regulations or any federal or Texas state laws, including but not limited to fraudulent telecommunications use.
  5. Spamming and Unsolicited Communications: Sending unsolicited bulk emails, messages, or other forms of spam that violate anti-spam laws or regulations.
  6. Fraudulent Activities: Engaging in identity theft, impersonating others, creating fraudulent accounts, or using the service to conduct scams or other deceptive practices.
  7. Network Abuse: Using the service to overload or disrupt our network or other users' services, including bandwidth abuse or engaging in activities that could impair the network's functionality for different users. Such as:
    1. Excessive Bandwidth Usage: Continuously using the service for high-bandwidth activities such as hosting servers, streaming large amounts of data, or engaging in peer-to-peer file-sharing beyond typical personal use, which negatively impacts network performance for other customers.
    2. Spamming or Flooding: Sending large volumes of data or repeated, unsolicited requests that flood our servers or other networks, including Distributed Denial of Service (DDoS) attacks or similar activities that degrade network stability.
    3. Massive Data Transfers: Transferring large amounts of data over short periods that exceed the usual consumption patterns or service plan allowances, thus straining network resources.
    4. Interference with Network Operations: Engaging in activities that cause disruptions, such as attempting to alter or impair the functionality of network equipment, modifying signal transmission, or intentionally causing interruptions or degradation of service.
  1. Hosting or Distributing Malware: Hosting, distributing, or transmitting viruses, ransomware, Trojans, or other harmful software or code.
  2. Threats, Harassment, or Hate Speech: Using the service to harass, threaten, or abuse others or to promote hate speech, violence, or discrimination based on race, ethnicity, gender, religion, or other protected characteristics.
  3. Interference with Emergency Services: Engaging in any actions that interfere with or impair access to emergency services, such as 911 or other critical communication channels.
  4. Resell or Unauthorized Sharing: Reselling, sharing, or redistributing the service to others without prior written authorization from Autophone of Laredo.
  5. Illegal Financial Activities: Using the service to conduct or facilitate illegal financial activities such as money laundering or financing illicit operations.
  6. Other Harmful Activities: Engaging in activities that may harm, disrupt, degrade, or impair the network or service quality or interfere with other customers' service use.
Violations may result in termination of your service and possible referral to law enforcement.


5. Term and Termination
Service Term: Your selected contract duration determines the service term. The service will automatically renew unless canceled by either party.
Termination by Customer:
  1. Fixed-Term contract: Early termination fees may apply if you cancel the service before the contract ends. These fees will be outlined in your service plan.
  2. Month-to-Month contract: You may cancel without incurring early termination fees, but a thirty-day (30) advance notification is required before cancellation. The cancellation will take effect at the end of the current billing cycle following this notice.
Termination by Autophone of Laredo: We reserve the right to terminate your service if you fail to comply with these Terms, including instances of non-payment or violations of our acceptable use policy or other related policies. Termination notices will be provided at Autophone’s discretion and when reasonably practicable.


6. Billing and Payments
Billing Cycle: Charges are billed monthly in advance, with any overages or additional charges billed at the end of the month or on the day the extra services are rendered. All charges are exclusive of taxes, meaning that applicable Texas sales taxes and any FCC-required regulatory fees will be added to the billed amount.
Late Payments: Late fees may be applied to overdue payments, late fees are defined as payments received more than nine days past the due date. Services will be suspended until the outstanding balance is paid, and a reconnection fee will also apply. If you fail to terminate the contract while an outstanding balance remains, your account will stay active, and regular service fees will continue to accumulate until the balance is fully settled and the contract is terminated properly.
Billing Disputes: You must notify us of any billing disputes within 30 days. Under the Texas Deceptive Trade Practices-Consumer Protection Act (DTPA), failure to dispute charges within this time frame may be considered acceptance of the charges.


7. Limitation of Liability
Service Limitations: Autophone of Laredo is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our services, including but not limited to loss of profits, revenue, or data, even if we have been advised of the possibility of such damages. To the extent permitted by Texas law, our total liability to you, regardless of the claim, is limited to the lesser of (a) the total amount paid by you for the service during the three months immediately preceding the event that gave rise to the claim or (b) $1,000. This limitation complies with FCC rules on network transparency.
Force Majeure: We are not responsible for service interruptions caused by events beyond our control, such as natural disasters, equipment failures, or government actions.


8. Warranty Disclaimer
Services are provided "as is" and "as available" without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties that may arise from a course of dealing, usage, or trade practice. Autophone of Laredo does not guarantee that the services will meet your requirements, be error-free, secure, uninterrupted, or free from defects or viruses. No advice or information obtained from Autophone of Laredo or its representatives shall create any warranty not expressly stated in this agreement.


9. Indemnification
You agree to indemnify and hold harmless Autophone of Laredo, its officers, employees, and affiliates against any claims arising from your use of the service, breach of these Terms, or violation of laws, including Texas state law and FCC regulations.


10. Compliance with FCC Regulations
Autophone of Laredo complies with the FCC's Open Internet Order, including transparency and non-discrimination rules. Network management practices, performance data, and service disclosures are made available to you in compliance with FCC regulations.


11. Changes to Terms
Autophone of Laredo reserves the right to modify these Terms at any time. Updated policy versions will be available online in our website's legal section. Customers are encouraged to review this section periodically to stay informed of any changes. Continued use of the service after changes constitutes acceptance of the revised Terms. If you disagree with the changes, you may cancel the service as outlined in the Termination section.


12. Governing Law and Dispute Resolution
Governing Law: These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
Dispute Resolution: Disputes related to these Terms or the service will be resolved through arbitration under Texas law and FCC requirements. Arbitration will occur in Laredo, Texas, and both parties waive the right to participate in class-action lawsuits. Arbitration costs will be handled according to the rules of the arbitration body unless otherwise specified in a separate written agreement between you and Autophone of Laredo.
